Appeal from a partial judgment of the United States District Court for the Eastern District of New York, Mishler, J., dismissing appellants' 42 U.S.C. § 1983 and state law claims arising out of an incident during which appellant student was slapped by one of his teachers. We hold that we have appellate jurisdiction despite the district court's defective certification of its partial judgment under Federal Rule of Civil Procedure 54(b) and affirm on the merits.
